1. Who We Are and What These Terms Cover

Eye Love Sunshine ("Eye Love Sunshine," "we," "us," or "our") operates www.eyelovesunshine.com (the "Site") and sells eyewear and related accessories. These Terms of Service ("Terms") govern your use of the Site and any purchase you make through it. By browsing the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. If you are younger, you may use the Site only with the involvement of a parent or guardian who accepts these Terms.

3. Your Account and Information

If you create an account or check out, you agree to give us accurate, current, and complete details and to keep them updated. You are responsible for keeping your login credentials private and for activity under your account.

4. Products, Pricing, and Availability

  • We work to show product colors, materials, and details accurately, but screens vary and handmade or artist-finished items may differ slightly from photos.
  • Limited-edition pieces may be produced in small quantities and may sell out without notice.
  • Prices, product offerings, and promotions may change at any time. We may correct pricing or description errors, including after an order is placed, and may cancel affected orders with a full refund.
  • Our sunglasses and frames are fashion and sun-protection accessories. Unless a product page states otherwise, they are not prescription eyewear and are not a substitute for an eye exam or professional eye care.

5. Orders and Payment

Placing an order is an offer to buy. We may accept, limit, or decline any order, including orders that appear fraudulent, are placed by resellers, or exceed quantity limits. Payment is processed by third-party providers through our e-commerce platform; we do not store full card numbers. You authorize us and our payment providers to charge your selected payment method for the total order amount, including any applicable taxes.

6. Shipping, Returns, and Exchanges

We offer free shipping on orders delivered within the United States. Shipping timelines, return windows, exchange options, and refund procedures are described on our Shipping & Returns page, which is part of these Terms. Title and risk of loss pass to you when the carrier delivers your package.

7. Promotions and Discount Codes

Discount codes and promotions are subject to the conditions stated when offered, have no cash value, cannot be combined unless stated, and may be changed or withdrawn at any time. We may cancel orders that misuse a code.

8. Intellectual Property

All Site content, including the Eye Love Sunshine name and logo, product designs, photography, text, graphics, and artwork, belongs to Eye Love Sunshine or its licensors, and is protected by copyright, trademark, and other laws. You may view the Site for personal, non-commercial shopping. You may not copy, reproduce, sell, modify, or create derivative works from any content without our prior written permission.

9. Acceptable Use

You agree not to: use the Site for any unlawful purpose; interfere with its security or operation; upload malicious code; scrape, harvest, or collect data by automated means; impersonate anyone; or infringe anyone's rights.

10. Feedback and Submissions

If you send us reviews, ideas, photos, or other material, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and adapt it in connection with our business. You confirm you have the right to share it and that it does not violate anyone's rights. We are not obligated to use or respond to submissions.

11. Third-Party Services and Links

The Site runs on Squarespace and may use other third-party tools (such as payment, shipping, and email providers) and may link to outside websites. We do not control and are not responsible for third-party services, content, or practices. Your use of them is at your own risk and subject to their terms.

12. Disclaimer of Warranties

Except as expressly stated on our Shipping & Returns page or as required by law, the Site and all products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Site will be uninterrupted, secure, or error-free.

13. Limitation of Liability

To the fullest extent permitted by law, Eye Love Sunshine and its owners, team members, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Site or any product. Our total liability for any claim relating to the Site or a product will not exceed the amount you paid for the product at issue. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

14. Indemnification

You agree to defend, indemnify, and hold harmless Eye Love Sunshine and its owners, team members, and partners from claims, losses, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms or your misuse of the Site.

15. Dispute Resolution

Informal resolution first. Before filing any claim, you agree to contact us through the contact form on the Site and give us at least 30 days to try to resolve the issue.

Binding arbitration. If we cannot resolve a dispute informally, it will be settled by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court. The arbitration will take place in the county where you reside, or by video or written submissions if you prefer. You will pay only the AAA filing fee required of consumers, and we will pay all other AAA consumer fees and arbitrator compensation. Either party may instead bring an eligible individual claim in small claims court. You and we each waive the right to a jury trial and to take part in a class or representative action.

Opting out. You may opt out of this arbitration agreement by sending us written notice through the contact form on the Site within 30 days after you first accept these Terms. Your notice should include your name, the email address used with your order or account, and a clear statement that you are opting out of arbitration. Opting out will not affect any other part of these Terms.

16. Governing Law

These Terms are governed by the laws of the State of California and applicable federal law, without regard to conflict-of-law rules.

17. Termination

We may suspend or end your access to the Site at any time if we believe you have violated these Terms. Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) will continue to apply.

18. Severability and Entire Agreement

If any part of these Terms is found unenforceable, the rest remains in effect. These Terms, together with our Privacy Policy and Shipping & Returns page, are the entire agreement between you and us about the Site. Our failure to enforce a provision is not a waiver of it.

19. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date will reflect the latest version. Continuing to use the Site after changes are posted means you accept them.
